A Life Care Plan is a “dynamic document based upon published standards of practice, comprehensive assessment, data analysis and research, providing an organized, concise plan for current and future medical needs and associated cost for individuals who have experienced catastrophic injury or chronic health care needs.”

Life Care Plans are helpful to:

  • Attorneys
  • Insurance companies
  • Trustees
  • Families
  • Rehabilitation and discharge planners

Catastrophic cases include but are not limited to:

  • Spinal card injury
  • Burns
  • Amputations
  • Brain injury – traumatic or acquired
  • Multiple trauma and complex injuries
  • Sensory loss (vision or hearing loss)
  • Chronic pain
  • Toxic exposure
  • AIDS
  • Progressive or debilitating disease
  • Other conditions or injuries with long term or life time medical needs

Arriving at a fair and just settlement or trust amount, plus the actual litigation of injury, is a complex part of a case. Whether it is (defense or plaintiff ) medical malpractice, personal injury, workers' compensation, or a product liability, you need to be able to support and defend the monies that are necessary to obtain or retain a reasonable quality of life for the client involved, for her or his life expectancy.

Medicare Set-aside Allocation

Medicare requires their interests be protected and designated as a secondary payer in workers compensation cases.  They will not be responsible for payment of work injury related medical care.  Each worker's compensation settlement should be reviewed and if Medicare’s criterion is met, a Medicare Set-aside is needed.
